El control de convencionalidad: cinco interrogantes

Resumen
El Tribunal Constitucional ha venido abiertamente a proclamar la competencia del juez ordinario para resolver los problemas de contradicción de las leyes con los tratados, asumiendo la prevalencia de estos sobre aquellas (control de convencionalidad). Tal doctrina suscita cinco interrogantes clave necesitados de aclaración para un correcto ejercicio del control de convencionalidad, sobre la base del máximo respeto hacia el sistema español de fuentes y de justicia constitucional.

Abstract
The Spanish Constitutional Court has clearly proclaimed that it is within the powers of the Ordinary Judge the solution of compatibility problems concerning Laws and International Treaties, giving primacy to the laters (conventionality control). The said doctrine raises at least five main issues, which must be explored in order to serve of guidance for a correct exercise of the conventionality control by Judges, presided by highest respect for the Spanish rules governing the system of sources of law and the constitutional judicial system.
